These Terms of Service ("Terms") govern your access to and use of the website at bcomai.com.au and any services provided by Bcom Services Pty Ltd (ABN 92 636 893 108), trading as bcom×ai ("we", "us", "our"). By using our website or engaging our services, you agree to these Terms.
1. Our services
We provide AI governance and risk assessment services, and AI Management System (AIMS) implementation services aligned to ISO/IEC 42001. The specific scope, deliverables, fees and timelines for any engagement will be set out in a separate proposal, statement of work or written agreement, which takes precedence over these Terms to the extent of any inconsistency.
2. No guarantee of certification or outcome
Our services support your organisation in establishing AI governance practices and preparing for ISO/IEC 42001 alignment or certification. We do not issue certifications. Certification to ISO/IEC 42001 is granted only by an accredited third-party certification body following its own independent audit. We do not guarantee any particular certification outcome, regulatory result or business result.
3. Professional information, not legal advice
Information provided through our website and services is general in nature and is intended to support responsible AI governance. It does not constitute legal, regulatory or professional advice for your specific circumstances. You should obtain independent advice where appropriate.
4. Your responsibilities
To deliver our services effectively, you agree to provide accurate and complete information, reasonable access to relevant staff and systems, and timely responses. You are responsible for decisions your organisation makes and for implementing and maintaining any recommendations we provide.
5. Intellectual property
All content on this website, and all frameworks, templates and methodologies we use, remain our intellectual property or that of our licensors. Deliverables prepared specifically for your engagement are licensed to you for your internal business use as set out in your engagement agreement. You must not reproduce or redistribute our website content or proprietary materials without permission.
6. Confidentiality
Each party agrees to keep confidential the non-public information disclosed by the other during an engagement, and to use it only for the purpose of that engagement, except where disclosure is required by law.
7. Fees and payment
Fees for services are as stated in your engagement agreement. Unless otherwise agreed, invoices are payable within the terms specified on the invoice. Amounts are stated exclusive of GST unless indicated otherwise.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with our services or these Terms is limited to the fees paid by you for the relevant engagement. We are not liable for indirect, incidental or consequential loss. Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law.
9. Website use
You agree to use our website lawfully and not to interfere with its operation or security. Our website may contain links to third-party sites; we are not responsible for the content or practices of those sites.
10. Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
11. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, with the "last updated" date shown above. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
