Terms of Service

Last updated: 21 September 2026

These Terms of Service ("Terms") govern your access to and use of the website at bcomone.com.au and any services provided by Bcom Services Pty Ltd (ABN 92 636 893 108), trading as Bcom ("we", "us", "our"). By using our website or engaging our services, you agree to these Terms.

1. Our services

We provide AI governance and risk assessment services, and AI Management System (AIMS) implementation services aligned to ISO/IEC 42001. The specific scope, deliverables, fees and timelines for any engagement will be set out in a separate proposal, statement of work or written agreement, which takes precedence over these Terms to the extent of any inconsistency.

2. No guarantee of certification or outcome

Our services support your organisation in establishing AI governance practices and preparing for ISO/IEC 42001 alignment or certification. We do not issue certifications. Certification to ISO/IEC 42001 is granted only by an accredited third-party certification body following its own independent audit. We do not guarantee any particular certification outcome, regulatory result or business result.

3. Professional information, not legal advice

Information provided through our website and services is general in nature and is intended to support responsible AI governance. It does not constitute legal, regulatory or professional advice for your specific circumstances. You should obtain independent advice where appropriate.

4. Your responsibilities

To deliver our services effectively, you agree to provide accurate and complete information, reasonable access to relevant staff and systems, and timely responses. You are responsible for decisions your organisation makes and for implementing and maintaining any recommendations we provide.

5. Intellectual property

All content on this website, and all frameworks, templates and methodologies we use, remain our intellectual property or that of our licensors. Deliverables prepared specifically for your engagement are licensed to you for your internal business use as set out in your engagement agreement. You must not reproduce or redistribute our website content or proprietary materials without permission.

6. Confidentiality

Each party agrees to keep confidential the non-public information disclosed by the other during an engagement, and to use it only for the purpose of that engagement, except where disclosure is required by law.

7. Fees and payment

Fees for services are as stated in your engagement agreement. Unless otherwise agreed, invoices are payable within the terms specified on the invoice. Amounts are stated exclusive of GST unless indicated otherwise.

8. Purchases made through this website

The AI Governance Assessment

What you are buying. A fixed-scope assessment for one organisation: onboarding, technical discovery, structured organisational investigation, system and register assessment, governance and regulatory gap analysis, and the AI Investigator Assessment Report with a management walkthrough. The price on the platform page is for one organisation of the size and scope we confirm with you before work starts; GST is shown at checkout and on your tax invoice.

Scope confirmed before work starts. Within one business day of payment we contact you to confirm your organisation's size and scope. If your organisation is materially larger than that price assumes, we tell you the revised price before any work begins; if you do not accept it, we refund your payment in full.

Delivery and rescheduling. Delivery is within up to five business days from the agreed start. Either of us may reschedule the agreed days with reasonable notice.

Cancellation and refunds. You may cancel for a full refund at any time before work starts. Once work has started, fees are not refundable except where the Australian Consumer Law requires otherwise or where we agree otherwise in writing.

What it is not. The assessment is not certification, an audit, or legal advice. Section 2 applies.

The Bcom One platform subscription

This part applies if you subscribe to the Bcom One platform through this website. It sits alongside the rest of these Terms; where an engagement agreement covers the same subject, that agreement prevails.

What the subscription is. An annual subscription for one organisation to the Bcom One AI governance platform, operated by us on your behalf. The current price is shown at checkout before payment details are entered, and on your tax invoice. Implementation, assessment and advisory work are separate engagements, quoted and agreed in writing.

Payment. Payment is processed by Stripe. We do not receive or store your card details. A tax invoice is issued for each payment.

Term and renewal. The subscription runs for twelve months from the date of purchase and renews for further twelve-month periods unless you tell us before the renewal date that you do not wish to renew. We will tell you in advance if the renewal price differs from the price you last paid.

Cancellation. You may cancel at any time by emailing support@bcomservices.com. Cancellation takes effect at the end of the period you have already paid for; fees for a period that has already started are not refundable, except where the Australian Consumer Law requires otherwise or where we have agreed otherwise in writing.

Onboarding. Bcom One is not self-service. After your subscription starts we contact you to arrange onboarding, which includes establishing your organisation in the platform, recording your accountable executive and setting up their sign-in. Until onboarding is complete the platform holds no records for your organisation.

Your records. The governance records created in your organisation's workspace are yours. On cancellation we retain them for the period we agree with you and then delete them; you may request an export of your records at any time while the subscription is active or during that retention period.

Availability and change. We take reasonable steps to keep the platform available and secure, but we do not guarantee uninterrupted availability. We may change platform features as the underlying framework and obligations change; we will not make a change that removes your access to records you have already created.

What the subscription is not. The platform does not certify you, and a subscription is not certification, an audit, or legal advice. Section 2 applies to the platform as it does to our services.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with our services or these Terms is limited to the fees paid by you for the relevant engagement. We are not liable for indirect, incidental or consequential loss. Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law.

10. Website use

You agree to use our website lawfully and not to interfere with its operation or security. Our website may contain links to third-party sites; we are not responsible for the content or practices of those sites.

11. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

12. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, with the "last updated" date shown above. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
